We are Westminster at Crabapple Homeowners Association Inc. (“Company,” “we,” “us,” “our“).

We operate the HOA wireless network WestminsterWifi (the “Wifi“), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms“) (collectively, the “Services“).

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you“), and Westminster at Crabapple Homeowners Association Inc., concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We will provide you with prior notice of any scheduled changes to the Services you are using. The modified Legal Terms will become effective upon posting or notifying you by [email protected], as stated in the email message. By continuing to use the Services after the effective date of any changes, you agree to be bound by the modified terms.The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.

We recommend that you print a copy of these Legal Terms for your records.

1. Purpose

The Westminster at Crabapple Homeowners Association provides Wifi at the community pool for the convenience of residents. These Terms of Use govern access to and use of the network to ensure safety, compliance, and responsible use.

2. Eligibility

  • Access is limited to homeowners in good standing
  • Each household must sign the Association’s Terms of Use Acknowledgement Form before receiving login credentials.
  • Credentials may not be shared outside the household.

3. Acceptable Use Requirements

Users agree to:

  • Use the network for lawful, personal purposes only.
  • Refrain from accessing, transmitting, or downloading any content that is illegal, harmful, discriminatory, or inappropriate for a family environment.
  • Avoid activities that could compromise network security, including attempts to bypass security controls, introduce malware, or access unauthorized systems.
  • Limit high‑bandwidth activities (e.g., large file downloads, streaming in 4K) during peak pool hours to maintain fair access for all users.

4. Prohibited Activities

The following activities are strictly prohibited:

  • Any illegal activity under federal, state, or local law.
  • Hosting servers, running commercial operations, or using the network for business purposes.
  • Attempting to intercept or monitor other users’ data.
  • Using the network to harass, threaten, or harm others.
  • Sharing login credentials with non‑authorized users.

5. Security and Privacy

  • The Association does not guarantee the privacy or security of data transmitted over the public Wi‑Fi network.
  • Users are responsible for securing their own devices, including enabling firewalls and keeping software updated.
  • The Association may monitor network traffic for security, performance, and compliance purposes.

6. Network Management

To maintain reliable service, the Association may:

  • Limit bandwidth or restrict certain types of traffic.
  • Suspend or revoke access for violations of these Terms.
  • Temporarily disable the network for maintenance or security reasons.

7. Liability

  • The Association provides the network as‑is and makes no warranties regarding speed, reliability, or availability.
  • The Association is not responsible for data loss, device damage, or security breaches resulting from use of the network.
  • Users assume all risks associated with connecting to a public Wi‑Fi network.

8. Enforcement

Violations of these Terms may result in:

  • Immediate suspension of Wi‑Fi access
  • Fines as permitted under the governing documents
  • Further action as authorized by the Board

9. Agreement

Use of the network constitutes acceptance of these Terms. HOA members must indicate their consent using the HOA’s homeowners form to receive login credentials.
